Michelin Files Suits Against Double Coin Dealers

Michelin has informed the media that it is filing suits against tyre dealers selling the Double Coin brand as it follows up previous notifications regarding the sale of tyres with tread patterns resembling those on Michelin truck tyres. The French tyremaker alerted more than 5,000 dealers of the risks involved in marketing these look-alike tyres sourced from Asia back in December 2005, stating that while the treads may look the same on both tyres, the look-alikes may not deliver the same grip or longevity as an authentic Michelin tyre.

With tyres bearing unauthorised copies of patented Michelin tread patterns still available on a number of markets 18 months later, the company has chosen to pursue legal action against dealers of these products in all countries where Michelin sales teams have identified the products.

Company Takes Legal Action to Release TREAD Act Data

Quality Control Systems Corp. has filed a Freedom of Information Act lawsuit in federal District Court to obtain secret data about deaths and injuries held by the National Highway Traffic Safety Administration (NHTSA). R.A. Whitfield, the company’s director, said that the public needs access to the Early Warning Reports collected under the Transportation Recall Enhancement Accountability and Documentation (TREAD) Act to better understand why so many deaths and injuries related to tire failures in the Ford Explorer have continued long after the well-known tyre recalls that affected the vehicle.

The TREAD Act was passed in October 2000 in response to Ford Explorer- Firestone tyre-related rollover deaths in the U.S. and Ford’s overseas recalls. TREAD amended federal transportation law to require vehicle and equipment manufacturers to report safety recalls or campaigns on vehicles and components in a foreign country if they also sold substantially similar products in the U.S. It also mandated NHTSA to create regulations governing quarterly Early Warning Reports — information on property damage and warranty claims, consumer, dealer and field reports, production numbers and deaths and injuries collected by manufacturers — with the intent of using the data to spot defect trends.

Michelin to Take Legal Action Against FIA

Michelin has initiated legal proceedings against the Fédération Internationale de l’Automobile (FIA) with the Tribunal de Grande Instance de Paris. The move sees the French manufacturer, which owns the BF Goodrich brands, request that the 27 February 2007 FIA World Motor Sport Council decision granting Pirelli the exclusive supply of tyres for the 2008, 2009 and 2010 World Rally Championships (WRC) be annulled due to irregularities in the tender process.

Michelin Going After Counterfeiters

(Akron/Tire Review) Groupe Michelin has gone on the attack against alleged counterfeit tyres, calling on the European Union Trade Commission to take action against a flood of counterfeit medium truck tyres, units the manufacturer said could pose highway dangers.

Bridgestone Settles With Chinese Manufacturer Over Patent Dispute

Bridgestone Corporation has announced that it has settled its patent infringement dispute with major Chinese manufacturer, Shandong Chengshan Tire Co, Ltd.

The dispute centres around the patents the Japanese manufacturer acquired on the design of its R288 and M858 radial truck and bus tyres. Bridgestone reports that in November 2004, the company “discussed continuously” with Shandong Chengshan asking it to cease production of its CST66 and CST88 Shandong Chengshan tyres. Bridgestone contended that these radial truck and bus tyres closely resembled the design of its R288 and M858 products.

Tyre Fill Industrial Espionage in South Africa

OTR tyre supplier the Roesler Group is considering legal action after allegations of industrial espionage were made against competitor, the US-based Carpenter Co, in South Africa.

Tyres & Accessories has seen security tapes, which the Roelser group alleges show Carpenter Co executives, bribing their way into a Benoni, South Africa, tyre plant. Copies of the original footage are believed to depict executives touring the Quality Tyres facility and examining prototype technology the company was testing on behalf of the German-based Roesler Group. According to the recordings, two men spent 20 minutes on the premises taking photographs and touring the Benoni, plant before leaving.

Goodyear Plant Workers Vote For Union

(Akron/Tire Review) Workers at Goodyear Tire & Rubber Co.’s wire plant in Asheboro, North Carolina, voted to be represented by the United Steelworkers (USW). A secret ballot election was held last week, with a final vote of 173-147 in favor of union representation. The USW said that Asheboro workers participated in a card check election in 2004 “that validated the USW as the official employee representative.” However, some workers there dissented, and legal action was taken. The National Labor Relations Board was brought in to conduct the secret ballot vote.

Cooper in Lawsuit with USWA

The United Steelworkers of America (USWA) is to be tied up in yet another lawsuit, this time with Cooper Tire & Rubber. A grievance has been filed to delay the sale of the company’s Cooper-Standard Automotive division to the Cypress Group and Goldman Sachs Capital Partners.

Legal action is being taken on behalf of the 1,500 USWA members that work in four of the division’s plants across America.

Zisser Banned from Selling Wanli S-1099

A US court has banned wholesaler Zisser Tire from selling Wanli S-1099 tyres, which, according to the ruling, infringe Yokohama’s trademarks.

Bandag faces negligence claim

International truck tyre retreading business Bandag is today facing a compensation claim for commercial negligence. The legal action comes from its former franchise partner Newman Tyre Services in response to a breach of an implied contract of good faith and fair dealing between the two companies.

More USA Strife For Bridgestone

A Class Action lawsuit against Bridgestone/Firestone filed on the 12th August in California has been transferred to the Eastern District of the US District Court. Thus allowing Federal jurisdiction on the California originated case. The Class Action lawsuit alleges that Bridgestone/Firestone’s Steeltex R4S, R4SII and A/T tyre series contain a lamination defect which can, and has allegedly, caused the entire tread of the tyre to separate leading to the tyre’s destruction. Causes of action in the lawsuit charged the tyre manufacturer with Fraudulent Concealment, Deceptive Practices in Violation of the CLRA, Violations of the Unfair Practices Act, Negligence and Strict Liability.Commenting on the removal of the lawsuit to federal court, Lisoni, acting for the plaintiffs, stated: “This legal action was filed to protect and represent the interests of Americans throughout the country who have purchased one of the more than 27.5 million Steeltex tyres manufactured.”Lisoni emphasised he has received scores of reports from Steeltex tire owners nationwide of tyre defects and damages as well as accidents and injuries resulting from the defects. The purpose of this lawsuit is not about money, Lisoni stressed, adding: “First and foremost, it is to motivate Bridgestone/Firestone to take responsibility for their defective product and do what is best for the safety of its customers-immediately recall the entire Steeltex tyre series.”

Legal Action Threatened In Poland Against Michelin

Press reports say that financial investors in Stomil Olsztyn, the Polish tyre maker, are threatening to take Michelin to court over alleged abuse of the rights of minority shareholders. There is a shareholders meeting, at which the disaffected investors are set to demand the appointment of an independent auditor to look into the financial links between Stomil and Michelin. Failing this, legal action will be taken, says the investors group.

Ford Considering Legal Moves Against Bridgestone

On the day when Ford is expected to announce a cut in dividend, there are press reports that the car manufacturer is contemplating legal action against Bridgestone for compensation of costs associated with the recall of tyres instigated by Ford. It is suggested that Ford has been involved in negotiations on this subject with Bridgestone in Japan, bypassing the company’s US subsidiary.
