Consultant Fired Over a Year Ago, Cooper Says

(Akron/Tire Review) Recent television news reports concerning Cooper Tire & Rubber Co. using an ex-con to conduct accident site investigations were more than they appeared to be, according to Cooper. According to a Cooper spokesman, the tyre maker did employ Frank Ruggier to investigate vehicle accidents on its behalf, but fired him “over a year ago” when the company discovered Ruggier had previously been convicted of insurance fraud and grand theft.

TV Reports Allege Cooper Tire Suit Evidence Issues

(Akron/Tire Review) Television news reports in Cincinnati, Cleveland and Detroit over the last week allege that Cooper Tire & Rubber Co. hired an ex-convict to investigate some allegedly tyre-related accidents on its behalf, collect evidence and deliver the accident site evidence to Cooper headquarters in Findlay, Ohio. In the televised reports, Cooper denied that its tyres are faulty or are to blame in tread separation accidents.

Judge Dismisses Class-Action Securities Suit Against Goodyear

(Akron/Tire Review) US District Court Judge John Adams has dismissed the class-action lawsuit alleging securities fraud filed against the Goodyear Tire & Rubber Co. and some of its current and former officers.

Michelin Accuses Aeolus Tyre of Infringement

Michelin, the world’s leading tyre manufacturer, has filed a lawsuit to the Beijing Chaoyang Court accusing Aeolus Tyre Co., Ltd and its agent Best Choice International Trade Co, Ltd of infringement, new sources have reported.

Strike Over At Firestone Liberia Plantation?

The strike action at Bridgestone Corp’s Firestone rubber plantation in Liberia has reportedly come to an end. The news has yet to be confirmed, but workers are said to have returned to work after government officials spoke to them. “The strike was provisionally called off. The workers have agreed to resume work after my intervention along with some other officials,” the Minister of Labour-designate told FrontPageAfrica.

Titan Trades Land in Brownsville Suit Deal

(Akron/Tire Review) Tire and wheel maker Titan International Inc has settled a dispute with the City of Brownsville, Texas, home of its now closed tyre plant, agreeing to give the city 73.5 acres of land. The agreement ends a two-year lawsuit filed by Brownsville in the wake of Titan’s sudden closing of the plant in 2003.

Parents sue Cooper

The parents of two young women killed in a head-on collision on Florida’s Turnpike are suing Cooper Tire & Rubber Company, alleging the company’s tyre caused a Thanksgiving 2004 wreck that left six dead. According to an associated press report, the lawsuit, in Palm Beach County Circuit Court, seeks more than $15,000 in the deaths of Michelle Seville, 23, and Marsha Seville, 18.

Bridgestone Accused of Using Slave Labour

The Washington-based International Labor Rights Fund has filed a Federal lawsuit alleging that Bridgestone Corp uses slave and child labour on its rubber plantation in Harbel, Liberia, news agencies have reported.

The suit seeks class action on behalf of 12 adult workers and 23 children and claims the plaintiffs could not bring similar court actions in Liberia because of fear of retribution and a corrupt court system. The suit requests a jury trial and unspecified damages, according to the Associated Press.

Racing Driver’s Widow Takes Goodyear To Court

The widow of drag racer Darrell Russell has filed a civil lawsuit in New Braunfels, Texas, against the Goodyear Tire & Rubber Co, the National Hot Rod Association (NHRA), and Simpson Helmets. Mr Russell died from a head injury on 27 June 2004, after the left rear tyre on his dragster exploded at more than 323 mph and he crashed during a race at Madison, Illinois.

US House Passes Lawsuit Bill

The US House of Representatives today followed the Senate’s lead and passed legislation that proponents hope will protect businesses from large-scale class action lawsuits, writes Tire Review. The House approved the same measure that won Senate approval on 10 February by a 279-149 vote. The new law will ban state courts from hearing multi-state class action suits, forcing those actions into the federal court system. The aim is to prevent plaintiff attorneys from “shopping” for sympathetic state courts to file lawsuits, and reap huge fees from multi-million dollar verdicts.

Goodyear Cleans Up

Goodyear has won a $159 million settlement from an insurance lawsuit over environmental clean up costs.

The lawsuit, originally filed in 1993, challenged insurance companies that would not honour the company’s policies and pay out for government ordered clean ups of its facilities.

The manufacturer said that the settlement will be paid over the next 15 months, however it is withholding the identity of the insurance companies involved.

Cooper in Lawsuit with USWA

The United Steelworkers of America (USWA) is to be tied up in yet another lawsuit, this time with Cooper Tire & Rubber. A grievance has been filed to delay the sale of the company’s Cooper-Standard Automotive division to the Cypress Group and Goldman Sachs Capital Partners.

Legal action is being taken on behalf of the 1,500 USWA members that work in four of the division’s plants across America.

Titan Cleared in Tractor Tyre Suit

According to an American news source a state district court jury in Brownsville has found Titan Tire Corp not liable in a $10 million lawsuit filed by the family of Raymundo Barrera.

The suit was filed following Mr Barrera’s death in October 2002, when a Titan tractor tyre he was filling with air exploded. Titan was charged with not providing instructions in Spanish on the tyre’s proper maintenance, but the jury unanimously found Mr Barrera at fault.

News reports state that Titan declined comment, as it is likely the plaintiffs will appeal.

Attorney Seeks Class Action Lawsuit Against Bridgestone-Firestone

It must feel like deja vu for Bridgestone-Firestone as a Californian attorney is seeking to expand complaints about alleged defects in Steeltex tyres into a national class-action lawsuit. Two Californians are suing Bridgestone-Firestone and the lawyer claims that the tyres are responsible for a dozen deaths and more than 100 injuries. Bridgestone-Firestone deny the allegations, pointing out that an 18-month investigation by the National Highway Traffic Safety Administration (NHTSA) found that the tyres out-performed some competitors’ tyres. Steeltex tyres are popular with owners of RVs and pickups, plus they are often fitted on ambulances.

Settlement In Lawsuit Case

An out-of-court settlement has been agreed in the USA in a case where three students are suing Bridgestone Firestone and a trailer rental company for $72 million, following an accident in 1999 involving a Ford Explorer, which overturned. The size of the settlement was not revealed, but Bridgestone Firestone was adamant that the settlement in no way implied any admission of liability.
